To OfferUp,
I am declining both the agreement to arbitrate and the class-action waiver in the new OfferUp Terms of Service.
Specifically, I am referring to the new OfferUp terms of service posted at https://offerup.com/terms effective 2024 April 8. I am opting out of the arbitration clause, and I am stating my disagreement to the class-action waivers, per section 21 "Dispute Resolution; Binding Arbitration".
Consider this an unequivocal statement that I wish to opt out of the arbitration clause and the class-action waiver in the OfferUp Terms of Service.

You have the right to opt out of binding arbitration within 30 days of the date you first accepted the terms of this Section 21 by emailing OfferUp at [email protected].
In order to be effective, the opt-out notice must include your full name and address and clearly indicate your intent to opt out of binding arbitration. By opting out of binding arbitration, you are agreeing to resolve disputes in accordance with Section 23.
