duplicate elements generated in final-fixup mode

When I use the following paragraphStyle in the style2tagmap, this somehow effects my ability to add elements in final-fixup mode.

  <paragraphStyle level="1" structureType="topicTitle" styleName="Heading 1" tagName="title">
     <topicrefProperties topicrefType="chapter"/>
     <topicProperties bodyType="body" format="topic" topicDoc="yes" topicType="topic"/>
  </paragraphStyle>

What ends up happening is that two elements are created instead of one. The template below generates two p elments.

    <li>
        <p>
            <xsl:apply-templates mode="#current"/>
        </p>
    </li>
</xsl:template>
