This End-User License Agreement ("EULA") is a legal agreement between you and Miners Online (hereinafter referred to as "Licensor").
This EULA agreement governs your acquisition and use of History Survival ("Software Product") directly from the Licensor or indirectly through an authorized reseller or distributor (a "Reseller").
Please read this EULA agreement carefully before completing the installation process and using the Software Product. It provides a license to use the Software Product and contains warranty information and liability disclaimers.
If you register for a free trial of the Software Product, this EULA agreement will also govern that trial. By clicking "accept" or installing and/or using the Software Product, you are confirming your acceptance of the Software Product and agreeing to become bound by the terms of this EULA agreement.
If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software Product, and you must not accept this EULA agreement.
This EULA agreement shall apply only to the Software Product supplied by the Licensor herewith regardless of whether other Software Product is referred to or described herein. The terms also apply to any the Licensor updates, supplements, Internet-based services, and support services for the Software Product, unless other terms accompany those items on delivery. If so, those terms apply.
The Licensor hereby grants you a personal, non-transferable, non-exclusive licence to use the Software Product on your devices in accordance with the terms of this EULA agreement.
- Load the Software Product (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the Software Product.
- Compile and modify the source code of the Software Product for your own personal purpose or to propose a contribution to the Software Product.
- Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Software Product nor permit the whole or any part of the Software Product to be combined with or become incorporated in any other Software Product, nor decompile, disassemble or reverse engineer the Software Product or attempt to do any such things, unless you are making a contribution to the Software Product.
- Remove or alter any copyright notices on any and all copies of the Software Product.
- Reproduce, copy, distribute, resell or otherwise use the Software Product for any commercial purpose.
- Allow any third party to use the Software Product on behalf of or for the benefit of any third party.
- Use the Software Product in any way which breaches any applicable local, national or international law.
- Use the Software Product for any purpose that the Licensor considers is a breach of this EULA agreement.
The Licensor expressly disclaims any warranty for the Software Product. The Software Product is provided 'As Is' without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, non-infringement, or fitness of a particular purpose. The Licensor does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the Software Product. The Licensor makes no warranties respecting any harm that may be caused by the transmission of a computer virus, worm, time bomb, logic bomb, or other such computer program. The Licensor further expressly disclaims any warranty or representation to Authorized Users or to any third party.
The Licensor shall at all times retain ownership of the Software Product as originally downloaded by you and all subsequent downloads of the Software Product by you. The Software Product (and the copyright, and other intellectual property rights of whatever nature in the Software Product, including any modifications made thereto) are and shall remain the property of the Licensor.
The Licensor reserves the right to grant licences to use the Software Product to third parties.
This EULA agreement is effective from the date you first use the Software Product and shall continue until terminated. You may terminate it at any time upon written notice to the Licensor.
It will also terminate immediately if you fail to comply with any term of this EULA agreement, or any subsequent updates. Upon such termination, the licenses granted by this EULA agreement will immediately terminate, and you agree to stop all access and use of the Software Product.
The provisions that by their nature continue and survive will survive any termination of this EULA agreement.
By accepting this EULA agreement you understand that the conditions of the EULA agreement may change at anytime, and you accept the new conditions. It is your responsibility to check for changes.
This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of the United Kingdom.
